Klin OS is operated and maintained by Klin Arts and Entertainment Ltd., a Brazilian private legal entity registered under the Simples Nacional tax regime, legally represented by its sole system operator, Mr. Caio Klinger (hereinafter, interchangeably, "Owner", "Klin Arts" or "we").

Klin OS is an internal, private-use operating system, developed by Klin Arts solely to serve the internal needs of the company, including, without limitation:
Klin OS is not a commercial product, is not a B2C service, is not a public SaaS, offers no external sign-up, processes no data of end users and provides no service of any kind to third parties.
Access to Klin OS is restricted to the Owner and, eventually, to internal collaborators expressly authorized in writing by Klin Arts, strictly within the scope of their assigned duties.
By the mere act of using Klin OS, the user states having read, understood and fully accepted these Terms of Service as well as the related Privacy Policy. Use of the system implies tacit and full acceptance of all provisions herein.
If the user does not agree with any provision of these Terms, they must immediately cease use of Klin OS.
Klin OS shall be used exclusively for the internal purposes of Klin Arts and Entertainment Ltd. The user is expressly prohibited from:
All source code, architecture, visual identity, texts, workflows, agent prompts, database structure and any other elements composing Klin OS are the exclusive property of Klin Arts and Entertainment Ltd. and/or Mr. Caio Klinger, protected by Brazilian Law 9,610/1998 (Copyright Act), Brazilian Law 9,279/1996 (Industrial Property Act) and applicable international legislation.
Data from integrated APIs remain the property of their respective platforms and/or of the Owner of the integrated accounts, in accordance with each platform's policies (TikTok, Spotify, Meta, Google, etc.).
No clause of these Terms grants the user any license, assignment or authorization to use Klin OS intellectual property, except those strictly necessary for ordinary internal operation of the system.
Klin OS integrates with official APIs of external platforms, including but not limited to: TikTok for Developers, Spotify for Developers, Meta (Instagram/Facebook Graph API), Google (YouTube Data API) and others that may be incorporated in the future.
All integrations strictly comply with:
Klin Arts is not liable for unavailability, unilateral changes to terms or revocation of access by integrated platforms.
Klin OS is provided "as is", in its current state, for the Owner's internal use. Given the strictly private nature of the system, Klin Arts and Entertainment Ltd.:
Any eventual liability of Klin Arts, regardless of the nature of the claim, is capped at the equivalent of one (1) Brazilian minimum wage in effect on the date of the event.
Processing of personal data by Klin OS is governed by the Privacy Policy, a document that forms an integral part of these Terms and is available at caioklin.com/privacy-en.html. That Policy expressly covers the Brazilian General Data Protection Law (Law 13,709/2018 · LGPD), the European General Data Protection Regulation (GDPR · Regulation (EU) 2016/679) and the California Consumer Privacy Act (CCPA), where applicable.
Klin Arts and Entertainment Ltd. reserves the right to modify these Terms of Service at any time, at its sole discretion, by publishing the updated version on this same page with the new "Last updated" date.
Users are advised to review this document periodically. Continued use of Klin OS after publication of a new version implies tacit acceptance of the changes.
Klin Arts and Entertainment Ltd. may, at any time and without prior notice, suspend or terminate access of any internal collaborator to Klin OS, as well as partially or fully discontinue the system, without any obligation to indemnify.
These Terms of Service are governed exclusively by the laws of the Federative Republic of Brazil.
The parties elect the Courts of the District of São Paulo, State of São Paulo, Brazil, as exclusively competent to settle any dispute arising from or related to these Terms, with express waiver of any other forum, however privileged it may be.
Any tolerance in the event of a breach of any provision of these Terms shall not constitute novation or waiver of the right to require, at any time, its strict performance.
Should any clause of these Terms be declared invalid or unenforceable by a competent authority, the remaining provisions shall remain fully valid and effective.
These Terms represent the entire agreement between the parties regarding the use of Klin OS, superseding any previous agreements, understandings or communications on the same subject.
